
No purchase or obligation of any kind is necessary to enter or win. A purchase will not increase your chances of winning. Many will enter and play, few will win.
1. SWEEPSTAKES PERIOD. The Serta® American Idol® Sweepstakes (“Sweepstakes”) begins at 12:01 a.m. Eastern Time (“ET”) on January 1, 2010, and ends at 11:59 p.m. ET on April 25, 2010 (“Sweepstakes Period”).
2. ELIGIBILITY. To enter the Sweepstakes, you must (a) be a lawful permanent resident of the fifty (50) United States or District of Columbia; and (b) be of legal age of majority in your jurisdiction of residence (and at least 18 years of age or older in the US) at the time of entry. This Sweepstakes is void where prohibited or restricted by law. Not open to contestants on the American Idol® show or to employees or immediate family members of employees of Serta, Inc. ("Sponsor"), Serta International, National Home Furnishings Association (“NHFA”), Fox Broadcasting Company, News America, Inc., Fox.com, AmericanIdol.com, Fox Digital Media, Inc., FremantleMedia North America, Inc., American Idol Productions, Inc., 19 Management, 19 TV Limited, 19 Merchandising Ltd., CKX, Inc., or any of their respective parents, subsidiaries, affiliates, dealers, retailers, resellers or advertising or promotion agencies (collectively “Excluded Parties”).
3. HOW TO ENTER. No Purchase Necessary.
a.) Take a “Serta Test Rest”: Participants are invited to take a “Serta Test Rest” in a bedding gallery at a participating retail location (to locate a participating retail location please visit www.homefurnishings.com and click on the retailer locator link). Follow all entry instructions listed on the Official “Serta Test Rest” Entry Form that will be provided by a retail Sales Associate starting January 1, 2010 and while supplies last (“Entry Form”). The Entry Form shall include a unique Test Rest Code (“Code”) and instructions on how to enter the Sweepstakes. Consumers are not required to take a “Serta Test Rest” to enter and may alternately request an Entry Form from a Sales Associate.
There are two (2) ways to enter once you receive an Entry Form:
1.) Online Entry: To enter online, obtain an Entry Form, visit www.SertaSweeps.com complete the information requested, along with the unique Test Rest Code indicated on the Entry Form, and submit the entry in accordance with the on-screen directions (“Online Entry”). Online Entries must be received by 11:59:59 p.m. ET on April 25, 2010 to be eligible. Limit one (1) Online Entry per person, each good for one (1) entry into the Sweepstakes drawing. Refer-a-Friend: When you complete your Online Entry, you will have the opportunity to enter up to five (5) valid friends’ e-mail addresses into the fields/boxes where indicated, and click to submit (maximum of five [5] referral entries per person for the entire Sweepstakes) (“RAF Entry”). You may only refer persons with whom you have an existing relationship and who are eligible to enter the Sweepstakes. Each friend will be sent a refer-a-friend email solely notifying him/her about the Sweepstakes. You may not refer a friend more than once. Referring friend(s) is not a requirement for your entry into the Sweepstakes. Each valid RAF Entry good for one (1) additional entry into the Sweepstakes drawing. Limit six (6) Entries per person submitted online during the Sweepstakes Period (in the form of one (1) Online Entry and five (5) RAF Entries);
OR
2.) Mail-In Entry: Validly complete and mail, in accordance with the entry instructions, an Entry Form in a #10 envelope with proper postage affixed to: Serta AI Sweeps Mail-In Entry, PO Box 1689, Melrose Park, IL 60661 (“Mail-In Entry”). Limit one (1) Mail-In Entry per outer envelope and six (6) Mail-In Entries per person during the Sweepstakes Period.
b.) Alternate Means of Entry (AMOE): Consumers can also enter by mail without taking a “Serta Test Rest”, without obtaining an Entry Form, and without any other obligation, by validly completing a 3” x 5" piece of paper with your first name, last name, complete street address (no P.O. Boxes), city, state, ZIP, daytime and evening telephone numbers (including area code), date of birth, and mailing it in a #10 envelope with proper postage affixed to: Serta AI Sweeps Postcard Entry, PO Box 8427, Melrose Park, IL 60661 (“AMOE Entry”). Limit one (1) AMOE Entry per outer envelope and six (6) AMOE Entries per person during the Sweepstakes Period.
Online, RAF, Mail-In and AMOE Entries are collectively referred herein as “Entries.” Limit six (6) Entries per person regardless of method of entry. Entries from any person in excess of the stated Sweepstakes Period limitation will be void. All Mail-in and AMOE Entries must be a) postmarked no later than April 26, 2010; and b) received no later than May 3, 2010; and c) hand-printed.
Excluded Parties are not responsible for lost, misdirected, late, postage due, incomplete, illegible or unintelligible Entries or for any incorrect or inaccurate entry information, whether caused by participant or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any technical or human errors that may occur in the processing of Entries. Illegible Entries are void, as are mechanically reproduced or automated Entries. Entries generated by script, macro or other automated or mechanical means and Entries by any means which subvert the participation process will be void. Prizes are subject to verification of eligibility and compliance with these Official Rules. All Entries must be submitted by the specified deadline to be eligible for the Sweepstakes drawing.
In the event of a dispute as to who submitted an Online Entry, entries will be deemed made by the authorized account holder of the email address submitted at time of participation and he/she must comply with these Official Rules. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address.
When you enter the Sweepstakes online, you can also opt-in to receive promotional offers and emails from Sponsor. You can opt-out of receiving such offers and emails at any time and opting-in does not impact your chances of winning.
4. PRIZES.
a.) Four (4) Grand Prizes: A trip for two (2) to Los Angeles, CA (“L.A.”). Prize consists of: Round-trip coach air transportation for two (2) between L.A. and major airport nearest winner's home; 2-nights hotel accommodations (one room; double occupancy) at a local hotel selected by Sponsor; ground transportation in L.A. between airport/hotel; two (2) tickets to the American Idol® Finale (“Finale”) scheduled to take place on May 20, 2010; and one (1) American Idol® Fan Pack (consisting of an American Idol® T-shirt, Hat, Journal, Bag and Judge’s Cup). See Rule 6 for Prize Restrictions. Approximate Retail Value (“ARV”): up to $5,065 each.
b.) 25 First Prizes: One (1) Nintendo® Wii™ Game Bundle consisting of one (1) Nintendo Wii Console and one (1) Nintendo Wii Game - Karaoke Revolution Presents: American Idol® Encore 2. ARV: $300 each.
c.) 100 Second Prizes: One (1) American Idol® Fan Pack (consisting of an American Idol® T-shirt, Hat, Journal, Bag and Judge’s Cup). ARV: $65.00 each.
d.) 500 Third Prizes: One (1) American Idol® iQuiz Game. ARV: $19.99 each.
Total ARV of all prizes to be awarded in the Sweepstakes is up to $44,250.
5. ODDS. Odds of winning depend on the total number of eligible Entries received during the Sweepstakes Period.
6. PRIZE RESTRICTIONS. Limit one (1) Sweepstakes prize per person and per household. Complete terms and conditions, including a Winner’s Release and Affidavit of Eligibility, will be furnished with prize notification. Any difference between the stated ARV and actual value, if any, will not be awarded. Actual value of the Grand Prize depends on city of departure. No cash equivalent will be awarded and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize (or portion thereof) for one of comparable or greater value, at its sole discretion. Any depictions of any prizes are for illustrative purposes only. All prize details are at Sponsor’s sole discretion. All federal, state and local taxes and all other costs and expenses associated with the acceptance and use of a prize not specifically set forth herein as being provided are the responsibility of the winners.
Additional Prize Restrictions for Grand Prize: Travel arrangements will be made through the travel coordinator designated by Sponsor on a carrier of Sponsor’s choice. If Grand Prize winner is unable to complete the trip on the dates specified by Sponsor, the winner shall forfeit the prize in its entirety, and an alternate winner will be selected, time permitting (as determined by Sponsor in its sole discretion). Winner and guest must travel on days designated solely by the Sponsor to coincide with the Finale tentatively schedule for May 20, 2010, which may change without notice. Winner and travel companion must travel on the same date(s) and on the same itinerary. No changes or substitutions. Grand Prize winner’s guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18 in the U.S.), unless child or legal ward of winner (in which case guest must be at least 8 years old), and must sign a liability/publicity release prior to issuance of travel documents. If guest is a child or legal ward of winner, winner must sign and return release on behalf of such child or legal ward. If, in the judgment of Sponsor, air transportation is not required due to winner's proximity to prize location, ground transportation may be substituted for round-trip air transportation and no compensation or substitution will be provided for the difference in prize value. Winner and guest are responsible for obtaining travel insurance (and all other forms of insurance) where applicable, at their option, and hereby acknowledge that the Sponsor has not and will not obtain or provide travel insurance or any other form of insurance.
Each Grand Prize winner is responsible for any other costs and expenses related to the acceptance and use of the prize, including but not limited to, additional ground transportation, meals, gratuities, telephone calls, room service, incidentals, trip and travel insurance premiums, and all other expenses not specifically identified in these Official Rules. Winners and their guests are responsible for obtaining all necessary travel documents. Seat locations will be determined by Sponsor. Tickets are subject to certain terms and conditions as specified thereon. In the event Sponsor is unable to provide tickets to any event, no compensation or substitution will be provided in lieu thereof; however, remainder of prize package will be awarded and Sponsor will have no further obligation to such winner. No responsibility is assumed for postponement or cancellation of Finale. Prize Winner is responsible for all taxes on prize and for all costs not specifically listed above, including meals, gratuities, etc. Additional travel restrictions may apply.
7. DRAWING AND NOTIFICATION OF WINNERS.
a.) Grand Prize Winners: The potential Grand Prize winners will be selected in a random drawing on or about May 4, 2010, at Sweepstakes Administrator’s location from among all eligible Entries received, by the Sweepstakes Administrator, an independent judging organization whose decisions on all matters relating to the Sweepstakes will be final and binding. Within forty-eight (48) hours of the drawing, the potential Grand Prize winners will be notified by phone, e-mail, and/or FedEx (or similar) (at the phone number, e-mail address, and/or address provided on the entrant’s Entry) at the Sponsor’s sole discretion. Potential Grand Prize winners will be required to sign, notarize and return an affidavit of eligibility and liability release and publicity release (where permitted by law) within forty-eight (48) hours after notice is sent, or the Grand Prize will be forfeited in its entirety and, at Sponsor’s discretion and time permitting, an alternate winner will be selected. A list of local area (to winner) notary services, and a pre-addressed, return postage-paid FedEx envelope, will accompany the prize notification sent to each potential Grand Prize winner. Each potential Grand Prize winner who is a legal resident of the 50 U.S. or D.C. will also be required to complete and return a W-9 Form, including his/her Social Security number, which will be used only for the purpose of reporting the winner’s prize earnings to the Internal Revenue Service as required by law. If prize winner is a minor under applicable state law, parent or legal guardian must sign all applicable verification documents.
Entrants need not be present at the drawing to win. If a potential Grand Prize winner fails to execute and return the required documents; cannot be reached after a reasonable effort has been exerted; he/she is found to be ineligible; he/she cannot or does not comply with these Official Rules; and/or if his/her prize or prize notification is returned as undeliverable, such potential Grand Prize winner will be disqualified, and, at Sponsor’s sole discretion and time permitting, an alternate potential Grand Prize winner will be selected at random from the remaining eligible Entries received.
b.) First, Second and Third Prize Winners: The prospective First, Second and Third Prize Winners will be selected in a random drawing on or about May 4, 2010, from among all eligible Entries received, by the Sweepstakes Administrator, an independent judging organization, whose decisions on all matters relating to the Sweepstakes will be final and binding. Entrants need not be present at the drawing to win. Within fourteen (14) days of the drawing, the potential First, Second Prize and Third Prize winners may be notified by phone, e-mail, and/or FedEx (or similar) (at the phone number, e-mail address, and/or address provided on the entrant’s Entry) at the Sponsor’s sole discretion. At the discretion of the Sponsor, prospective winners may be required to sign and return an address verification and/or mutually acceptable liability release and publicity release (at the discretion of the Sponsor and where permitted by law) provided to the prospective winner, or the prize will be forfeited in its entirety and an alternate winner will be selected. If a prize winner is a minor under applicable state law, parent or legal guardian must sign all applicable verification documents.
If a potential First, Second Prize or Third Prize winner fails to execute and return the required documents, cannot be reached after a reasonable effort has been exerted; he/she is found to be ineligible; he/she cannot or does not comply with these Official Rules; and/or if his/her prize notification and/or prize is returned as undeliverable, such potential First, Second Prize or Third Prize winner will be disqualified, and, at Sponsor’s sole discretion, an alternate potential prize winner will be selected at random from all eligible Sweepstakes Entries. Unless otherwise informed, winners will receive their prizes via mail within four (4) weeks of Sponsor completing the verification process.
8. General: By participating, entrants agree to (i) abide by and be bound by these Official Rules and the decisions of Sponsor and judges, which shall be final and binding in all matters relating to this Promotion and (ii) to release and hold harmless Sponsor and Excluded Parties, and each of their respective directors, officers, employees, agents and assigns (collectively, the “Released Parties”) against any and all claims and liability, including injuries, losses or damage of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly from acceptance, use, misuse or redemption of a prize (including any injury or harm resulting from the use of a vehicle) or participation in this Promotion. Acceptance of a prize constitutes permission for the Sponsor and its designees to use winners’ names, likenesses, addresses (cities and states) and/or photographs for advertising, promotion, marketing and other purposes in any media now known or hereafter devised, worldwide, in perpetuity, without further compensation, notification or permission, unless prohibited by law. Released Parties are not responsible for technical, hardware or software, or telephone problems or malfunctions of any kind, lost or unavailable network server, Internet service provider, cable, satellite website, or other connections, or failed, incorrect, incomplete, inaccurate, lost, stolen, misdirected, mutilated, undelivered jumbled, scrambled, garbled or delayed Entries; or other electronic communications; or for any errors, problems or malfunctions of any kind whether caused by computer, network, technical, mechanical, printing, typographical, seeding or human error, or otherwise, relating to or in connection with this Promotion, including, without limitation, errors, problems or malfunctions which may occur in connection with the administration of the Promotion, the processing of mail-in requests, Entries, the announcement of the prizes or in any promotion-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALFIY ANY SUCH ENTRANT AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW. If due to a computer, network, seeding, technical, mechanical, human, programming or other error, more prizes are claimed for any day than are intended to be awarded for that day, Sponsor reserves the right to award the stated prize(s) for the day(s) at issue in a random drawing from among all valid prize claims received for such prize(s). In no event will Sponsor be liable for more than the stated number of prizes. If, in the Sponsor’s opinion, there is any suspected evidence of tampering with any portion of the Promotion, or if virus, bugs non-authorized human intervention, technical difficulties or other causes compromise the integrity, administration or conduct of the Promotion, the Sponsor reserves the right to void suspect Entries and to modify or terminate the Promotion (or portion thereof), and if terminated, at their sole discretion, to conduct a random drawing to award the prizes using all non-suspect, eligible Entries received as of date of termination in a manner deemed reasonable by the Sponsor, in its sole discretion.
